KindCode Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any KindCode mobile application (each an "App," and together the "Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps. These Terms form a binding agreement between you and KindCode ("we," "us," or "our").

2. Description of Service

KindCode Apps provide software-based experiences such as audio learning, article extraction, podcast creation, safety reporting, productivity tools, and other utilities. Features vary by app and may rely on third-party services, including artificial intelligence (AI) providers, for processing.

The Narrator: Audio Learning & Article Extraction

The Narrator lets you convert articles, documents, and topics into audio lessons and podcast episodes. The app may extract text from URLs or files you provide, generate summaries and scripts, and produce audio using text-to-speech services. Output is stored locally on your device.

Quizzik: AI Study & Flashcard Companion

Quizzik helps you study by turning documents, images, audio, and topics into flashcards, quizzes, and narrations. You retain ownership of any study materials you submit. We process them solely to generate study content for you. Generated decks, quizzes, and narrations are stored locally on your device.

3. User Accounts

Most KindCode Apps, including The Narrator, do not require you to create an account. For apps that do offer accounts, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. User Conduct

You agree not to use our Apps to:

  • Violate any applicable law, regulation, or third-party rights
  • Infringe copyrights, trademarks, trade secrets, or other intellectual property
  • Distribute harmful, abusive, defamatory, obscene, or otherwise objectionable content
  • Attempt to reverse engineer, decompile, or tamper with our Apps
  • Interfere with the security or availability of our services
  • Use automated means to scrape, mine, or harvest data from our Apps without permission

5. Intellectual Property

All content, code, designs, trademarks, and materials provided in our Apps are owned by KindCode or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Apps or their content except as expressly permitted by these Terms or applicable law.

6. AI-Generated Content

Some KindCode Apps use third-party AI services to generate summaries, scripts, audio narration, replies, or other content. AI-generated output is provided for your convenience and may not be accurate, complete, or suitable for every purpose. You are solely responsible for how you use, share, or rely on AI-generated content. KindCode does not claim ownership of your original input, and we do not guarantee the originality of AI-generated output.

7. Third-Party Content & Site Extraction

Where an app extracts text from websites, documents, or other third-party sources, we cannot guarantee that extraction will succeed or that the resulting content will be accurate, complete, or current. You are responsible for ensuring that your use of extracted content complies with the source site's terms of service and applicable copyright laws. KindCode is not liable for extraction failures or for content provided by third parties.

8. Subscriptions & In-App Purchases

Some Apps may offer subscriptions or one-time in-app purchases. All purchases are processed through Apple's App Store or Google's Play Store and are subject to the respective store's terms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period through your account settings. Pricing and features are described within the App before purchase.

9. Disclaimer of Warranties

Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the Apps will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, KindCode and its owners, employees, affiliates, or licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of or relating to your use of our Apps, even if advised of the possibility of such damages.

11. Termination

We may suspend or terminate your access to our Apps at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using our Apps at any time.

12. Children's Privacy

Our Apps are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us so we can delete it.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted in the App and reflected in the "Last Updated" date. Your continued use of our Apps after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Arkansas.
